How Upset Bids Work

In North Carolina, after a foreclosure sale, there is a 10-day upset bid period where any party can submit a higher bid. Each new upset bid restarts the 10-day period.

Minimum Bid Increase

Under N.C.G.S. § 45-21.27, the minimum raise is:

  • 5% of the current high bid
  • Or $750, whichever is greater

Required Deposit

You must deposit 5% of your new upset bid amount (not the raise), with a minimum of $750 — cash, certified check, or cashier's check payable to the Clerk of Superior Court.

Upset Bid Period: 10 days from sale or last upset bid

Filing Hours: 8:30 AM - 5:00 PM, Monday - Friday

Note: Bids must be received before 5:00 PM on the last day of the upset period.
